Tinjauan Yuridis Terhadap Peralihan Hak Atas Tanah Melalui Jual Beli (Studi Kasus di Kabupaten Bima)

Abstract


Indonesia is an agricultural country, which is why most of the population depends on agricultural products for their livelihood. So land is the source of life in a broad sense. In human life land plays an important role because most of human life depends on land. This journal aims to determine and analyze the legal provisions governing the transfer of land rights through sale and purchase and the process of implementing land sale and purchase in Bima Regency. Research Results: The implementation of the transfer of land ownership rights through sale and purchase in Bima Regency basically still refers to the provisions of the Basic Agrarian Law (UUPA), and its implementing regulation, namely Government Regulation Number 24 of 1997 concerning land registration. There are some factors that affect the transfer of land ownership rights through sale and purchase without being conducted in the presence of a Land Deed Official (PPAT), the lack of public knowledge about land regulations, the existence of people who apply for the transfer of land ownership rights through sale and purchase without using a deed, the location of the land being traded does not have clear boundaries, and there is no approval from the heirs (siblings) and the land to be sold is still in a state of dispute. Research recommendations; Land Office officials and Land Deed Officials (PPAT) in Bima Regency should work together in an integrated and systematic manner to conduct legal counseling to the community, especially to rural communities so that they can know and understand the importance of the transfer of ownership rights to land based on buying and selling in front of a land deed official. In order for the implementation of the Basic Agrarian Law to be truly achieved, let the apparatus engaged in the land sector continue to refer to the applicable provisions and in their application consistently.
