Analisis Bentuk Transaksi Penjualan Pakaian Bekas Dalam Tinjauan Fiqih Muamalah

Abstract

A market can be described as a place where providers of goods, seekers of goods and make an agreement based on an agreed medium of exchange. When we talk about mua'amalah we refer to the interpersonal relationships that exist between humans to ensure a peaceful and secure existence. Transactions that occur between sellers and buyers of used clothing bal-balan system in Sudiang Traditional Market allegedly contain elements of gharar (uncertainty) that can harm buyers and result in legal uncertainty according to the views of scholars and fuqoha. The problems that will be discussed are how the form of used clothing buying and selling transactions in the Sudiang traditional market and how the system of used clothing buying and selling transactions in traditional markets in the review of muamalah fiqh.This research is Field Research (field research). The data sources in this research are primary data and secondary data. The data collection technique uses observation, interview, and documentation techniques. The method used is a qualitative method with a case study approach. This research will be conducted at the Sudiang traditional market.The results of this study state that the practice of buying and selling used clothing transactions is carried out between used clothing traders and agents located in Butung Market where agents get used clothing from distributors while distributors get used clothing from manufacturers/suppliers of goods located abroad. Traders buy used clothes to agents with an order system but there are also traders who come directly to Butung Market to buy them. This used clothing order uses a code system, with this code system ordering that determines the contents of the goods. The sale and purchase of used clothes in the bal-balan system at the Sudiang Traditional Market according to the perspective of fiqih muamalah is a prohibited sale and purchase because it contains elements of gharar, causing the sale and purchase to be invalid because it does not fulfill one of the pillars and conditions of sale and purchase, namely regarding the object being traded, the quality and quantity are unknown so that it can potentially cause losses to both parties
