Determining the Origin of Children from Sirri Marriages Based on Hifz al-Nasl in Maqasid Syari'ah

Abstract


This study examines the legal determination of the origin of children born from sirri (unregistered) marriages based on the principle of Hifz al-Nasl within the framework of Maqasid Syari'ah. The research aims to analyze the significance of preserving lineage as the primary legal basis for recognizing the status of children born from religiously valid but unregistered marriages in Indonesia. This study employed a qualitative approach using normative legal research based on library research. The findings reveal that Islamic law recognizes the validity of sirri marriages provided that all essential pillars and legal requirements are fulfilled, whereas Indonesian positive law requires marriage registration to establish legal certainty. Consequently, judicial determination of a child's origin serves as an important legal mechanism to protect lineage (Hifz al-Nasl), safeguard children's legal identity and civil rights, and realize justice and public welfare. The study concludes that the preservation of lineage should become a fundamental legal consideration in determining the origin of children born from sirri marriages while harmonizing Islamic legal principles with Indonesia's positive legal system.
